One of the most frequently asked questions we receive is whether a permit is required to place a dumpster on a property in Miami-Dade County. The answer is simple in most cases, but there are important exceptions that every homeowner and contractor should understand before scheduling a delivery.
The Short Answer
On private property: No permit needed. If you’re placing the dumpster on your own driveway, in your yard, or on a private construction site, you do not need a permit in most Miami-Dade municipalities.
On public property: Permit required. If the dumpster needs to be placed on a public street, sidewalk, alley, or right-of-way, you will typically need a permit from your local city government.
This distinction covers the vast majority of situations. Since most residential dumpster rentals go on driveways and most commercial rentals go on private job sites, the majority of our customers do not need any permit at all.
When You DO Need a Permit
There are specific situations where a permit is necessary.
Street or road placement. If your property doesn’t have a driveway or the driveway is too small, and the dumpster must sit in the street, you’ll need a right-of-way permit. This requires approval from the city to temporarily occupy public road space.
Sidewalk placement. Placing a container on or blocking a public sidewalk requires a permit and sometimes a pedestrian detour plan, especially in commercial areas.
Swale or easement placement. The grassy area between the sidewalk and the curb (the swale) is typically public property. Placing a dumpster there may require permission.
Metered parking areas. In commercial districts where parking is metered, you’ll need to coordinate with the city for temporary parking removal.
Historic districts. Areas like the Art Deco Historic District in Miami Beach or parts of Coral Gables may have additional requirements and restrictions.
Permit Requirements by Municipality
Miami-Dade County contains 34 incorporated municipalities, each with their own rules. Here’s what some of the major cities require.
City of Miami. A right-of-way permit from the Public Works Department is needed for street placement. These typically take a few business days to process and require a fee. The dumpster must not block traffic flow, and reflective markers or barricades may be required.
City of Miami Beach. Miami Beach has strict rules about containers in public spaces. A permit is required for any placement outside private property, and there may be restrictions on placement duration, especially in tourist-heavy areas.
City of Coral Gables. Known for strict code enforcement, Coral Gables requires permits for street placement and has aesthetic requirements. The city may also restrict how long a dumpster can be on a residential property.
City of Hialeah. Generally follows standard Miami-Dade guidelines. Permits required for street placement, no permit for private property.
Unincorporated Miami-Dade. Areas governed directly by Miami-Dade County follow the county’s Public Works Department rules. Right-of-way permits are needed for street placement.

HOA Rules and Restrictions
Even when no government permit is required, your homeowners association may have its own rules about dumpsters. Common HOA restrictions include:
- Advance notice requirements — you may need to notify the HOA board before placing a container
- Time limits restricting how long a dumpster can be on the property, sometimes as short as 7 days
- Placement requirements — the container must be in the driveway and not on the lawn
- Size restrictions — some HOAs allow only certain dumpster sizes
- Screening requirements — the dumpster must be hidden from street view with fencing or tarps
Violating HOA rules can result in fines, so it’s worth checking your community’s CC&Rs (covenants, conditions, and restrictions) before ordering a dumpster.
How to Get a Dumpster Permit
If you determine that a permit is needed, here’s the general process.
Contact your city’s public works department or building department. Many municipalities now accept permit applications online. Provide the address, duration of placement, dumpster size, and a site plan showing where the container will be located. Pay the permit fee, which varies by city but typically ranges from $25 to $200. Wait for approval, which usually takes one to five business days. Once approved, the dumpster can be delivered to the permitted location.
Some municipalities may require additional measures like:
- Reflective tape on the container
- Traffic cones or barricades at night
- Removal of the dumpster within a specified timeframe
Tips to Avoid Permit Issues
The easiest way to avoid permit headaches is to place the dumpster on private property. Here are strategies that work for most situations.
Use your driveway. This is the most common and easiest option. A standard 20-yard dumpster fits in most two-car driveways.
Use your yard. If the driveway isn’t available, placing the container on your lawn is an option. Consider placing plywood underneath to protect the grass and distribute weight.
Use the job site. For construction projects, place the dumpster within the property boundaries of the job site.
Share a neighbor’s driveway. With your neighbor’s permission, you may be able to use their driveway if yours is unavailable. This avoids public property placement.
Coordinate with your contractor. If you’re hiring a contractor for the project, they may already have permits or know the local requirements.
